Four and a half year old Braxton Bergman is currently hospitalized at Loyola University Medical Center in Maywood. He has a severed spleen, a severed liver, two broken collar bones, six broken ribs, four broken vertebrae, and collapsed lungs.
The injuries are the result of what Will County authorities have called a "freak accident," but it's an accident his dad Johnny says was entirely preventable.
Johnny was watching his son last Friday as he rode his bike (with training wheels) up and down the sidewalk outside of their Plainfield home.
That's when the Chevy Suburban that was parked two doors down started rolling down the neighbors' drive....and eventually right over Braxton. Both wheels on the passenger side crushed the boy.
Inside the Suburban was a two-year old girl, who Bergman's attorney alleges hit the gear shift on the steering console, and knocked the vehicle out of park. She had been left unattended in the S.U.V.
Bergman, with the help of lawyer Kathleen Zellner, filed a two million dollar lawsuit Thursday against those neighbors who left their daughter unattended- alleging gross negligence.

Of course the neighbors are at fault! There is no reason for a two year child to be unattended in a vehicle while the vehicle is running. Bergman has a very solid case in my opinion. If anyone thinks otherwise there is something wrong with the way you think!
